Children born outside the UK:

We are specialists in UK Immigration and Nationality matters, we can advise whether your child is British by birth.  A child born outside the UK is British if their parent(s) are British by being born in the UK or by naturalisation.  

Some children aren't British automatically, because their parent(s) are "British by descent", usually because they were born outside the UK also. For example, a child born in UAE to a British parent who was born in Australia. In this case, a child is not British at birth, but can be registered with UK Home Office, Nationality Department in Liverpool, under certain conditions, such as if the British parent lived in the UK for 3 years before the child's birth.

Example #1: child is British automatically. A child is born in the Philippines to a British father and a Filipina mother. The father was born in the UK, therefore the child is British at birth. 

Example #2: child is British automatically. A child is born in India to a parent who was born in India, but naturalised as a British citizen after living/working in the UK. The child is British at birth. 

Example #3: child isn't British automatically but can be registered. A child is born in Australia to a parent who is British but was also born in Australia. The child isn't British at birth. However, the parent lived in the UK for 3 years during his/her studies before the child was born. A child can be registered as British (an application to the Home Office) under Section 3(2) of Nationality Act, then you can apply for a passport. 

Example #4: child isn't British automatically and cannot be registered. A child is born in the UAE to a British parent who was born in the USA. The other parent isn't British. The British parent has not lived in the UK for min 3 years before the child's birth. The child isn't British and there is no claim to registration. You have to obtain him/her a passport from another country. You can still register the child as British one day in the future, if you move all together to the UK and live there for 3 years (and still before the child turns 18), which would be under Section 3(5) of the Nationality Act.
